Utah sued by ACLU over immigration law

SALT LAKE CITY — Two national organizations are suing Utah to halt a new immigration law they claim encourages racial profiling.

The National Immigration Law Center says an enforcement measure signed by Gov. Gary Herbert in March is just as unconstitutional as a similar Arizona law that courts have already struck down. The American Civil Liberties Union also has joined the lawsuit filed Tuesday in federal court in Salt Lake City.

The most controversial parts of Arizona’s law are on hold pending a trial. They include a provision that would require police officers who are enforcing other laws to question the immigration status of those they suspect are in the country illegally.

Utah’s law requires people to prove their citizenship only if they’re arrested for a felony or class-A misdemeanor.

The national groups say states are not allowed to trump federal law and that the Utah law violates the constitutional protection from unlawful search and seizure.

  1. The laws of the Constitution clearly states that to become a citizen of the U.S. you need to come through LEGALLY. If we don’t follow the Constitution we might as well throw out all other laws which will breed total chaos. Citizenship in no way, shape or form has anything to do with racial profiling. This is a lame excuse by the ACLU. It is just totally ridiculous. The sooner we disregard the ACLU and their tactics the better our country will be. They have done nothing but cause our country heartache and destruction. Citizenship is offered to everyone as long as they abide by the rules of entrance and they follow the Constitution. It is not for the illegals to come in and change our rules and courts to fit their cultures and background. Citizen or non-citizen who thinks they can come into a country and change the rules/courts to their beliefs or live off the monies of other people needs to be stripped of their citizenship and shown the the way out of the country.
    Because our presidents have allowed people to come across the border in droves than there should be no reason why anyone can’t be stopped and asked to see their ID cards. I would be proud to show them mine. Our leaders allowed this mess to take place when illegal immigrants were coming across the border and they were doing nothing. Seems to me they wanted to create this chaos. Their job is to protect the people and they surely were not doing the job they were voted in to do. What can we learn from this? Follow the laws of the land….it will save you a lot of trouble in the end.

  2. if illegal immigrants get arrested and questioned for any reason, it seems pretty obvious that the police officer will be able to figure out they are not in the country legally without having to ask too many questions. seems like a moot point.

  3. The congress should defund the aclu.But it’s up to the American people in 2012,to throw out Obama,23 socialist in
    congress and 10 rions. If you want to start to get back to the constitution.The poeple of Utah should throw out anybody
    who will vote against the constitution and all the other
    states should do the same thing.
