4th Circuit puts Heracron injunction on hold
Listen to this articleWILMINGTON, Del. — A federal appeals court has stayed an injunction against a South Korean company that lost a trade-secrets battle with the DuPont Co.
Kolon Industries says the 2-1 decision by the 4th U.S. Circuit Court of Appeals means it can continue selling its Heracron fiber products while it appeals last month’s decision by a U.S. District Court judge in Virginia.
The federal judge in August barred Kolon from producing any para-aramid fibers for 20 years after the company lost a court fight over high-strength synthetic fibers used in products such as Kevlar body armor.
The judge previously upheld a $920 million damage award for DuPont and a jury finding that Kolon misappropriated DuPont’s Kevlar technology.
Kolon is seeking to overturn both the damages judgment and the injunction.
DuPont says the appeals court ruling only maintains the status quo during the appeal and does not affect the $920 million verdict.
