FREDERICK — A Frederick developer is seeking $37 million for what it claims is the Army’s failure to stop toxic chemicals from Fort Detrick from polluting groundwater off post.
The Frederick News-Post reported Thursday on a claim that Waverly View Investors LLC filed with the Army.
A Fort Detrick lawyer says he’s looking into the allegations. He says the post has six months to respond before Waverly can file a federal lawsuit.
Waverly accuses the Army of devaluing 92 acres on which the developer plans to build more than 700 homes.
The industrial solvents TCE and PCE have tainted ground water beneath Fort Detrick. The chemicals also have been found in some nearby private wells and Carroll Creek.
Waverly has refused to let the Army drill test wells on its property.
