A legal brief about illegal briefs

You ever have the dream where you are in front of strangers wearing nothing but your underwear? If one Delaware man had that dream tonight, I imagine he would be OK so long as it was his own underwear.

That’s because Andrew Walls has alleged he woke up from a 2012 colonoscopy to find he was wearing pink women’s underwear, according to a lawsuit filed earlier this month.

Walls was placed under general anesthesia for the procedure at the Delaware Surgery Center in Dover. According to the lawsuit:

When the plaintiff recovered from the effects of the anesthesia administered by defendants, he awoke to realize that while he was unconscious pink women’s underwear had been placed on his body. When the plaintiff initially presented for his colonoscopy he had not been wearing pink women’s underwear and at no time did the plaintiff voluntarily, knowingly or intentionally place the pink women’s underwear upon himself.

Walls’ lawsuit seeks damages for intentional infliction of emotional distress.

It remains unclear whose underwear he was wearing.
