MAUNG MYINT, et al. v. STATE FARM INSURANCE

The dispute arises from a Md. statute that prohibits collecting uninsured motorist benefits before exhausting the limits of any available liability insurance.

Maung Myint and Aye Mya Wilmering appeal the grant of summary judgment by the Circuit Court for Howard County in favor of State Farm Insurance, appellee, in a claim for uninsured motorist benefits. Myint and Wilmering were in a car accident on September 20, 2010, when their vehicle was sideswiped by a phantom vehicle. As a result, Myint’s car left the road and ended up on the shoulder of I-95, at an angle, with the rear of the vehicle partially extending into the left lane. Myint’s car was then struck by a vehicle driven by a former defendant to this action named Keith Freeman.
