Xavier M. N. Tates v. State of Maryland

Following a trial in the Circuit Court for Washington County, a jury convicted Xavier Maurice Nathaniel Tates, the appellant, of two counts of second-degree assault and two counts of reckless endangerment. The trial court sentenced him to a total of 15 years’ incarceration.

The appellant presents two questions for review, which we have rephrased slightly:

I. Was the evidence legally sufficient to sustain the convictions for second-degree assault and reckless endangerment of Jessica Pettner?

II. Did the trial court err by not merging for sentencing the conviction for second-degree assault of Jessica Pettner into the conviction for reckless endangerment of Jessica Pettner?
