DESMOND JOHNSON v. STATE OF MARYLAND

After a jury trial in the Circuit Court for Prince George’s County, appellant, Desmond Johnson, was convicted of robbery and second-degree assault. He was sentenced to incarceration for a term of 15 years, with all but 10 years suspended, for the robbery. The second-degree assault count merged for sentencing purposes.

QUESTIONS PRESENTED Johnson presents the following two questions for our consideration:

I. Did the trial court commit plain error in failing to give a missing witness instruction?

II. Is the evidence insufficient to sustain the robbery conviction?
