STATE OF MARYLAND v. DOMONIC FAULKNER

On April 2, 2013, Domonic Faulkner, appellee, was indicted for first-degree murder and related charges arising out of the murder of David Womack on March 4, 2013. On October 4, 2013, appellee filed a motion to suppress statements that he had given to police officers. On August 6, 2014, Judge Thomas Waxter (Ret), specially assigned, (motion court) conducted an evidentiary hearing on the motion. On August 7, 2014, the motion court denied the motion. On October 7, 2014, the day of trial, defense counsel asked the trial judge, Judge Lynn K. Stewart Mayes, (trial court) to reconsider the ruling on the motion to suppress. The court agreed to do so, watched a video recording of the proceedings before the motion court,
and granted the motion. The State filed a notice of appeal. We shall reverse.
