JAMES WILLIAM RATLEDGE v. STATE OF MARYLAND

Criminal procedure — Jury instruction — Mistake of fact

Convicted, after a jury trial in the Circuit Court for Cecil County, of attempted voluntary manslaughter, first-degree assault, and use of a handgun in the commission of a crime of violence, James Ratledge, appellant, presents two issues for our review:

I. Did the trial court err in refusing to instruct the jury on mistake of fact? II. Did the trial court err in providing the jury with a written copy of the instructions that included only the definitions of the crimes charged, and not the entire set of instructions?
