Criminal law — Sufficiency of the evidence — Telephone misuse
Following a bench trial in the Circuit Court for Anne Arundel County, James Armstead, appellant, was convicted on one count of telephone misuse. The circuit court sentenced appellant to serve three years incarceration, all but six days suspended, and three years of unsupervised probation.
In his timely filed appeal, appellant presents two questions for our consideration, which we have reordered:
1. Did the trial court err in permitting the charging document to be amended over defense’s objection?
2. Was the evidence insufficient to sustain the conviction for telephone misuse?
