Md. high court considers if marijuana smell justifies vehicle search

The mere smell of marijuana emanating from a car in Maryland does not give police officers probable cause to search the vehicle, because the possession of less than 10 grams of the drug is a civil offense – not a crime – under state law, a defense attorney told Maryland’s top court last week.
