Md. approves first medical cannabis dispensary

Maryland’s fledgling medical cannabis program moved one step closer to opening with the approval of the first dispensary in the state.

The Maryland Medical Cannabis Commission gave final approval to Wellness Institute of Maryland, located in Frederick County near the intersection of Buckeystown Pike and English Muffin Way. The dispensary plans to offer home delivery to patients who cannot pick up their medicine once the drug becomes available.

Currently, just one of the 15 growers — Stevensonville-based ForwardGro — has received final approval to grow marijuana.

The program continues to be mired in missteps and courtroom wrangling.

The Court of Appeals is expected later this summer to take up an appeal by an association representing processors and growers who are seeking to be heard in opposition to a request for an injunction that could further delay the program.

In June, the Court of Appeals denied a motion by Alternative Medicine Maryland, LLC seeking to keep in place a temporary injunction issued by Baltimore City Circuit Court Judge Barry Williams that barred the state’s medical cannabis commission from issuing additional growing or processing licenses.

Alternative Medicine Maryland, a minority-led company, is one of three companies suing the state commission, citing what it says are failings of the commission. None of the 15 licenses that were preliminarily approved went to companies with minority ownership.

The Maryland Wholesale Medical Cannabis Trade Association and potential patients are seeking to intervene in a lawsuit filed in Baltimore City Circuit Court. Attorneys for the association argued last month that Williams erred when he denied the group the ability to participate in the hearing on the preliminary injunction.
