FRANCIS JOSEPH MALLEY v. STATE OF MARYLAND

Criminal procedure — Illegal sentence — Exceeds plea agreement

Francis Joseph Malley pleaded guilty in the Circuit Court for Baltimore County to second-degree burglary and was sentenced to a term of fifteen years imprisonment, with all but four years suspended, to be followed by three years of supervised probation. In this appeal, we must decide whether that sentence exceeded the terms of the plea agreement previously accepted by the court. We conclude that it did and will vacate the sentence and remand the case for resentencing.
