Administrative law — Disability retirement benefits — Accidental disability

On December 12, 2017, Robert Gunter, Jr., appellant, applied to the State Retirement and Pension System (“RPS”), appellee, for disability retirement benefits due to a psychological injury he suffered while employed as a correctional officer at the Eastern Correctional Institute (“ECI”). The RPS Medical Board recommended that Mr. Gunter be approved for ordinary disability, but not accidental disability because “the facts alleged [did] not constitute an accident.” The RPS Board of Trustees (the “Board”) accepted this recommendation and denied his request for reconsideration of the accidental disability claim. Mr. Gunter appealed to the Office of Administrative Hearings (“OAH”).
