KAYLA ASHLEY NELSON V. STATE OF MARYLAND

Criminal procedure — Ineffective assistance of counsel — Failure to investigate

A Baltimore City jury convicted appellant Kayla Nelson of one count of illegal possession of oxycodone. The court sentenced her to serve three years in prison. Nelson petitioned for post-conviction relief, asserting that she was denied the effective assistance of counsel. The circuit court held a hearing and denied her petition. This Court granted an application for leave to appeal to address one issue: “Did the circuit court err in denying post-conviction relief where (1) trial counsel failed to investigate and obtain certain key medical records and (2) that failure prejudiced the defense by depriving Appellant of critical evidence corroborating her testimony?”
