In a case predating the 2009 amendment of Estates & Trusts §13-105, The Orphans’ Court properly dismissed a Petition for Guardianship of the Person for lack of jurisdiction when at least one of the natural parents was alive, parental rights had not been terminated, and no testamentary appointment had been made.
