Custody: Tie-breaker authority: Willingness to cooperate
CSA No. 1726, Sept. Term 2012. Unreported. Opinion by Zarnoch, J. Filed Oct. 28, 2013. Appeal from Montgomery County. Affirmed.
Given the mother’s history of excluding the father from their child’s life, as well as extensive testimony from both parents and other witnesses that indicated that the father was willing and able to share the decision-making while the mother was not willing to do so, the circuit court did not abuse its discretion by granting joint legal custody with tie-breaker authority to the father.
