Child support: Imputed income: Private school costs
CSA No. 2188, Sept. Term 2011. Unreported.

Appeal from Anne Arundel. Vacated.

In calculating child support, the circuit court erred by imputing income to an unemployed father despite finding he was not voluntarily impoverished, by finding that father had agreed to send the children to private school when the undisputed evidence was to the contrary, and in failing to determine whether father’s proportional obligation for the cost of private school would significantly impair his ability to support himself.
