In order to declare a 3-year-old child a CINA, it was enough that the mother was incarcerated following the death of another child and that the 3-year-old’s father could not be located; the court did not also need to find the mother had abused the 3-year-old or determine the actual cause of death of the infant, who died in her mother’s bed after the mother went to sleep intoxicated.
