U.S. court rejects developer’s lawsuit against Fort Detrick

A federal judge is dismissing a alleging groundwater pollution reduced the development value of neighboring private property.

Judge Catherine Blake made the ruling Tuesday in U.S. District Court in Baltimore.

She says Waverley View Investors LLC failed to show that Defense Department environmental directives barred the Army from burying certain toxic chemicals in unlined pits at the installation in Frederick from 1955 to 1972.

Waverley acquired an adjacent, 93-acre parcel in 2012. It sought $37 million in damages, including more than $13 million in lost property value.

Attorneys for Waverley declined to comment on the ruling.

The Environmental Protection Agency added the fort’s landfill site to the so-called Superfund list of the nation’s most polluted industrial sites in 2009.
