FlightAware withdraws lawsuit against Kalshi over flight-cancellation markets
Flight-tracking company FlightAware withdrew its lawsuit against Kalshi on Tuesday, a day after it filed the suit that accuses the prediction markets giant of using its data and name without its knowledge to host gambling markets on flight cancellations.
The case has been “voluntarily dismissed, without prejudice, against all defendants,” lawyers for FlightAware wrote in the latest filing.
Neither company immediately responded to Reuters’ requests for further comment.
The U.S. flight cancellation contract for the week ending August 14 remained available on Kalshi’s website, although it no longer named FlightAware as the source.
The disclaimer on Kalshi’s flight cancellation contract page reads “outcome verified from Primary Source Agency,” which links to FlightAware’s website. Earlier it said the outcome was verified “from Flight Aware”.
Kalshi’s disclaimer says: “This market and these products have not been endorsed by the Primary Source Agency or its affiliates. Any references to the Primary Source Agency’s delay and cancellation page, or any associated marks are descriptive only and do not indicate an endorsement of this product or any affiliation between the Primary Source Agency or its affiliates and Kalshi.”
FlightAware was seeking unspecified damages as well as court orders barring Kalshi from using its data when it filed the lawsuit in the U.S. District Court for the Southern District of New York.
