Don McGahn, the former White House counsel who returned to Jones Day as a partner, defied a subpoena and did not testify before the House Judiciary Committee in May.
The House Judiciary Committee sought testimony and records from McGahn. The White House directed him not to testify and he did not appear at the committee hearing on May 21.
The Justice Department argued that the law and precedent gave McGahn immunity from appearing before the committee because of his closeness to the president when he was White House counsel.
Rep. Jerry Nadler, D-New York and chairman of the committee, has threatened to hold McGahn in contempt for failing to testify.
This week’s Pulse Poll question asks whether McGahn’s firm, Jones Day, should have instructed him to comply with the subpoena.
