Zoning — Billboards — Digital billboard

Appellant Bay Properties 2, LLC. (“Bay Properties”) appeals from the denial of its application to convert its existing paper billboard to a digital billboard.

At the time of its application, Baltimore City zoning law permitted the construction of a new digital billboard only when the applicant provided “documentation that at least 3 existing billboard faces have been removed.” On the other hand, it allowed “changes” to existing billboards so long as they were approved by the Baltimore City Board of Municipal & Zoning Appeals (the “BMZA”).
