Edward Cole (“Cole”) appeals from an order of the Circuit Court for Montgomery County entering summary judgment in favor of Auto Dent Care, Inc., Auto Options, and Auto Options, LLC (collectively “Auto Dent”). Cole sued Auto Dent for negligence, asserting that he was injured when he stepped on a broken grate in Auto Dent’s parking lot. Auto Dent filed a third-party complaint against Montgomery County (“the County”) seeking indemnification and claiming that the grate was on county land.
